Nomad Creations – Photo Gallery Terms of Service

Welcome to the Nomad Creations online photo gallery. By accessing, viewing, or downloading images from this gallery, you agree to the following terms and conditions. If you do not agree with any part of these Terms of Service, please do not use the gallery.

1. Ownership of Content

All photographs, digital images, and related media presented in this gallery are the intellectual property of Nomad Creations unless otherwise stated.

  • Copyright: Remains with Andre Rodriguez / Nomad Creations.

  • Licensing: Clients may receive a license to use delivered images under terms specified in their individual contracts (personal use, commercial use, etc.).

  • Watermarked Proofs: Proofs provided in the gallery may be watermarked and are not for reproduction or public sharing unless explicitly permitted.

2. Access & Usage

  • Private Galleries: Access is limited to the client and any third parties the client chooses to share the gallery with.

  • Login Credentials: Clients are responsible for keeping gallery links and passwords secure.

  • Download Rights: If download permissions are granted, clients may only use the images as licensed. Downloading does not transfer copyright.

3. Image Use Restrictions

You agree not to:

  • Modify, edit, or apply filters to images in ways that misrepresent the photographer’s work.

  • Use the images for resale, redistribution, or commercial purposes unless explicitly permitted.

  • Use proofs or unauthorized images on social media, websites, or for print without purchasing or licensing.

4. Gallery Availability

  • Hosting Period: Galleries will remain online for [e.g., 30/60/90] days from delivery unless otherwise arranged.

  • Archival: After this period, Nomad Creations may archive or delete the gallery. Reactivation may incur a fee.

  • Backup Responsibility: Clients are encouraged to download and back up their images during the active gallery period.

5. Payment & Orders

  • Prints & Products: All orders placed through the gallery (e.g., prints, canvases, albums) are final. No refunds are offered unless the product is defective.

  • Digital Purchases: All digital file purchases are final and non-refundable.

  • Taxes & Fees: Applicable taxes or transaction fees may be added during checkout.

6. Privacy & Data

  • Nomad Creations respects your privacy and will not share your gallery without your permission.

  • Data collected via the gallery platform (e.g., email, IP address) may be used to improve services or fulfill orders. See our [Privacy Policy] for details.

7. Limitation of Liability

Nomad Creations is not responsible for:

  • Lost, deleted, or corrupted files after the gallery period ends.

  • Misuse of images by third parties if clients publicly share their gallery.

  • Print or color variations caused by non-calibrated monitors or third-party labs.

8. Modifications

Nomad Creations reserves the right to modify these terms at any time. Updated terms will be posted on this page and will apply to all future gallery use.
